Wireless Properties "Saddened, Shocked" By FCC Decision

Says Ruling On Missionary Ridge Cell Tower "Politically Motivated"

Wireless Properties president Larry Wells said Friday he is "saddened and shocked" by an adverse ruling from the Federal Communications Commission on a planned cell tower on the side of Missionary Ridge.

He called it "a politically motivated decision."

Rep. Zach Wamp and Sens. Lamar Alexander and Bob Corker had written the FCC asking it to re-evaluate the tower they said would be in the view of the National Park Service's Bragg Reservation.

The FCC on Thursday denied the petition of Wireless Properties and said it should refile its application to provide a full review.

Mr. Wells called it a "much-needed, life-saving tower."

He said, "The FCC becomes the second taxpayer-funded federal agency to not follow time-tested federal statutes, violate the Bill of Rights and trample the United States Constitution.

"The ruling from the FCC is quite narrow and direct as it only contains two words 'Bragg Reservation' as its reason for denial of Wireless Properties' petition.

"The Tennessee state Historic Preservation Office is on record as being well aware of the Bragg Reservation's location in regard to the proposed tower.

"While I respect the offices of my fellow Tennesseans' Sens. Alexander and Corker as well as Congressman Wamp, it is our position they were misled by certain individuals and groups so that the elected officials made public statements and representations to the Federal Communications Commission.

"The position of the elected officials undoubtedly affected the outcome of the politically appointed officials and staff of the FCC.

"At the end of the day, I place my faith in the frames of our Godly-directed Constitution. The United States is very blessed to have had such visionaries in its formation and along the development of our great Republic.

"When all of the facts and the truth are exposed, perhaps some may be shocked as to the real elements behind this matter.

"Wireless Properties will vehemently and aggressively defend itself in this matter. We are proud of our 23 successful track record as a major regional tower developer and will continue to grow our portfolio of shared wireless communication towers which benefit all of the public who use wireless both in everyday and emergency situations."
