Chancellor Ellen Lyle of Nashville said she will rule in two to four weeks on a motion by EPB seeking to dismiss a lawsuit filed by the Tennessee Cable Telecommunications Association.
Chancellor Lyle heard arguments in the case on Friday morning.
EPB maintains that the Cable Association’s claims that its Fiber to the Home plan complies with all requirements of state law.
“We are convinced that the court will see this lawsuit for what it clearly is – an attempt by the Cable Association to limit the choices and options for Chattanoogans,” said Harold DePriest, EPB’s President and CEO. “We have set forth a conservative business plan that takes into account the best interest of our community. We are confident in our business plan and in our ability to win this case in court.
"However, every month that the cable lobbyists attempt to draw this suit out becomes one more month that our community must wait for the choices they tell us they want.”
