Veteran County School Board member has agreed to do even days of public service in the case in which she was charged with shoplifting from the Lookout Valley Wal-Mart.
In exchange, the district attorney's office will not appeal a ruling by riminal Court Judge Rebecca Stern granting Ms. Boydston judicial diversion.
Ms. Boydston has three months to do the seven days.
She also agrees to stay out of Wal-Mart.
Her attorneys, Tom Crutchfield and Sam Robinson, said it remains a judicial diversioin and Ms. Boydston is not admitting any guilt.
Under judicial diversion, the charge can be expunged from the record if the defendant gets in no further trouble for a year.
Ms. Boydston, who was charged with theft under $500 in the incident last July 25, has maintained she had no intent to shoplift.
A loss prevention officer said she witnessed Ms. Boydston dropping items into her purse.
She said after Ms. Boydston paid for some groceries, but not the items in the purse, she zipped shut the purse.
Ms. Boydston was stopped after she passed all points of sale.
The officer, Christina Hooper, said the total value of the items in the purse was $31.18.
Ms. Boydston said earlier that she had her purse open in her buggy and dropped the items in there instead of in the buggy as she should have.
