Charges Bound To Grand Jury Against Mizell

The grandfather of a six-year-old girl who was almost abducted at the Ace Hardware in East Brainerd said he "wanted to kill" the man after he jerked his granddaughter away from him.

Kenneth Scoggins testified on Tuesday morning that he held Jeremy Mizell at bay for 8-10 minutes, then chased him around until finally knocking him in a ditch.

Charges of especially aggravated kidnapping, attempted first-degree murder and attempted rape were bound to the Grand Jury by General Sessions Court Judge Christie Sell.

The state is also asking that a suspended sentence against Mizell on a paint huffing conviction be ordered into execution. A hearing will be held later on that matter.

Mizell remains held on no bond.

Mr. Scoggins said he went with his daughter and her young daughter and four-year-old son to the hardware on East Brainerd Road to get flowers.

He said they looked at flowers for about half an hour on the hardware parking lot, while the two kids played nearby.

He said the children were about 20-25 feet away near a fountain when he looked up and saw the boy jump off a concrete wall. He said he took off after him.

The witness said when he did he saw a man wearing only shorts (with no shirt and no shoes) leading his granddaughter toward his car.

He said they were about 10 feet from the car and two doors were open on the vehicle.

He said the man had his granddaughter in a bear hug from behind.

He said he asked his granddaughter, "Why didn't you scream, baby?" He said he did not believe she could have made a sound because the man was squeezing her so tight.

Mr. Scoggins said he picked up a piece of concrete block and ran toward the man. He said he held the block in his right hand, while jerking his granddaughter away with his left.

He said the man told him he did not plan to harm her.

Mr. Scoggins said he held him at bay for 8-10 minutes, but the man started running when he heard police sirens. He said he chased the man across East Brainered Road, then back across it to Graysville Road. He said he finally caught up with him and hit him with the block, knocking him in a ditch. Police took him into custody there.

The witness said his granddaughter has nightmares from the incident.

An investigator said Mizell told him he planned to take the girl to an undisclosed location and have vaginal sex with her. He said he then planned to kill her.

The investigator said Mizell also said he had lured the girl toward him by offering her a cookie, then he grabbed her when she got close.

Police earlier said they found pornography in Mizell's vehicle.
