b)         An ordinance to amend Ordinance 12523 known as “the Fiscal Year 2011-2012 Budget Ordinance” to appropriate an additional $2,496.80 to the Southeast Tennessee Development District/Chattanooga Area Regional Council of Governments for a total amount of $38,534.80 for the City’s assessment dues based on the 2010 census population data.

b)         An ordinance to amend Chattanooga City Code, Part II, Article X, Chapter 24, Stopping, Standing, and Parking, so as to create the Chattanooga Parking Authority and delegate certain duties to the Chattanooga Area Regional Transportation Authority (CARTA) to make certain other amendments as set forth herein.  (Revised.)

 

c)         MR-2012-044 Shane Lloyd c/o John Wise (Abandonment).  An ordinance closing and abandoning of an alley located in the 100 block of Kent Street, more particularly described herein.  (Recommended for approval by Public Works.)  (Public Works has denied the abandonment of the 200 block of Spears Avenue and Kent Street with AT&T Southeast to maintain their easement in the full width.)

a)         A resolution adopting a five-year Capital Improvements Plan for fiscal years 2013-2017, subject to future revision; a copy of which is attached hereto and made a part hereof by reference.  (Deferred from 6/26/2012.) 

 

b)         A resolution authorizing the Administrator of the Department of Parks and Recreation to execute a two (2) year License Agreement (with three (3) additional optional one-year terms) for the River City Ducks, LLC, for the use of the Ross’ Landing ramp to access the Tennessee River for the operation of an amphibious vehicle in an amount of $300.00 per month for the full calendar year.

 

c)         A resolution authorizing the Administrator of the Department of Parks and Recreation to extend a Conservation Services Agreement with the Trust for Public Land, in an amount not to exceed $100,000.00 to be paid in four (4) quarterly installments of $25,000.00 each for a term of one (1) year beginning July 1, 2012, through June 30, 2013.

 

d)         A resolution authorizing the Chattanooga Housing Authority as manager of Dogwood Manor to pay ServPro for emergency clean-up of a kitchen fire due to water damage of certain apartments at Dogwood Manor, in the amount of $12,000.00 on behalf of the City.

a)         An ordinance to amend Chattanooga City Code, Part II, Chapter 10, Section 10-5, as amended, to exclude certain property from Walnut Hill Town Homes Lots 3 and 4 from the Fire District boundary.

 

b)         An ordinance to amend the Charter of the City of Chattanooga, and all acts, ordinances, and other charter provisions amendatory thereof, pursuant to the provisions of Article XI, Section 9, of the Constitution of the State of Tennessee (Home Rule Amendment) so as to make applicable state law provisions to recall popularly elected officials of the City of Chattanooga.

 

c)         2012-075 Flagship Group/Gordy Germany (R-1 Residential Zone to C-2 Convenience Commercial Zone).  An ordinance to amend Chattanooga City Code, Part II, Chapter 38, Zoning Ordinance, so as to rezone property located at 5390 Hixson Pike, more particularly described herein, from R-1 Residential Zone to C-2 Convenience Commercial Zone, subject to certain conditions.  (Recommended for approval by Planning and Staff.)  (District 3.)

            2012-075 Flagship Group/Gordy Germany (R-1 Residential Zone to C-2 Convenience Commercial Zone).  An ordinance to amend Chattanooga City Code, Part II, Chapter 38, Zoning Ordinance, so as to rezone property located at 5390 Hixson Pike, more particularly described herein, from R-1 Residential Zone to C-2 Convenience Commercial Zone.  (Applicant Version.)

 

7.         Resolutions:

 

a)         A resolution authorizing the Administrator of the Department of Public Works to award Contract No. W-10-007-202, Altamont Pump Station Renovation, to Haren Construction Company, in the amount of $678,000.00, with a contingency amount of $70,000.00, for an amount not to exceed $748,000.00, subject to SRF loan approval.  (District 2.)  (Temporary Restraining Order.)  (Deferred from 6/19/2012.)

 

b)         A resolution authorizing the Mayor to enter into an Interlocal Agreement with the Hamilton County Water and Wastewater Treatment Authority and the City of Rossville, Georgia, relative to the employment of a consultant and a vendor for the development of a billing and collection system for sewer charges.

 

c)         A resolution authorizing the Director of General Services to execute an easement for part of property located at 1600 Edgewood Lane to Gordon Street for a driveway, subject to certain conditions.  (District 2.)

d)         A resolution to amend Resolution No. 27080 so as to remove the property address of 4801 Greenview Lane in the amount of $7,673.00 and authorizing the Administrator of the Department of Neighborhood Services and Community Development to use the funds for a similar project wherein the contract with All-Timate Construction, LLC is reduced from $41,000.00, including contingencies, to $33,327.00.  (District 2.)

e)         A resolution authorizing Jordan T. Bozeman to use temporarily the right-of-way located at 405 Market Street for patio space, awning, aluminum canopy, and store front furring along a portion of said right-of-way, as shown on the maps attached hereto and made a part hereof by reference, subject to certain conditions.  (District 8.)

 

f)         A resolution authorizing the Administrator of the Department of Public Works to enter into an agreement with Jacobs Engineering Group, Inc. for professional services relative to Contract No. W-12-008-101, project management for the Consent Decree Implementation, in an amount not to exceed $2,446,211.00 for the first year of the agreement.

 

g)         A resolution authorizing the Administrator of Education, Arts, and Culture to enter into an agreement with Pointe General for Phase 1 of the renovation of the Soldiers and Sailors Memorial Auditorium Community Theatre, in the amount of $946,242.00, plus a contingency fund of $50,000.00, for a total amount not to exceed $996,242.00.

 

h)         A resolution authorizing the Mayor to execute an agreement with Chattanooga Area Regional Transportation Authority (CARTA) regarding revenue reimbursement during period for transition of parking enforcement.

 

i)          A resolution authorizing the Director of General Services to accept a bid from Eastman Construction for the interior build-out of the 11th Street police station, in the amount of $174,189.00.  (District 8.)

Crime Stoppers: Fraudulent Suspect At Hobby Lobby

Crime Stoppers and the Chattanooga Police Department are seeking information regarding a fraudulent suspect from Hobby Lobby on Gunbarrel Road in Chattanooga. On March 18, at approximately 2:23 p.m., the suspect entered Hobby Lobby at 2286 Gunbarrel Road. TBI Charges Maine Man In Pornography Case

The Tennessee Bureau of Investigation obtained federal warrants for a Maine man in a child pornography investigation that resulted in his arrest earlier this week. Jermany Scott Claus, 39, was charged with enticing a minor to engage in sexually explicit conduct to produce a visual depiction for said conduct and receipt of child pornography.
