A Criminal Court jury has declined to bring in guilty rape verdicts in a case in which Robbie Jermaine Reed was charged with breaking into an apartment and raping an unconscious woman.
A state witness said the woman was passed out drunk on the floor in her apartment when she and a friend left for 30 minutes to get cigarettes.
She said when she returned she first thought she heard laughter inside. She said she then found Reed in the room and the woman crying.
In the two-day trial conducted by Judge Rebecca Stern, Reed was charged with three rape counts - anal rape, oral rape, vaginal rape.
All rape counts were B felonies carrying 8-30 years in prison.
Verdicts were:
Count 1 aggravated burglary
Verdict: guilty aggravated criminal trespass
Count two: vaginal rape (B felony)
Verdict: sexual battery (E felony)
Count three: anal rape
Verdict: not guilty
Count four: oral rape
Verdict: not guilty
Sentencing is Nov. 5. His attorney, Robin Flores, said Reed faces 1-2 years as a range one offender.
