Lookout Neighbors Go To Court Over Water Runoff Issue

Two Lookout Mountain neighbors have gone to court over a water runoff issue.

Rodolph Davenport IV is suing Fort Stephenson Avenue neighbors W. Thorpe McKenzie and Frances S. McKenzie in Circuit Court.

The suit, filed by attorney Marvin Berke, says the McKenzies altered the landscape on their property and that changed the discharge of runoff onto the Davenport tract.

It says afterward both parties made certain changes to their properties and "the problem was partially alleviated.

"

The suit says, "However, at a later time, the defendants allowed certain pipes on their property to burst without repairing them causing water to come from under ground and above ground on to the land of the plaintiff eventually entering into his house and the foundation of his house causing severe damage to the property of the plaintiff and causing mold to accumulate in his house."

The suit asks $60,000 in damages. 


CSLA Under Lockdown As Officers Conduct Search

Baylor's Popp Wins First Spring Fling State Title
