Attorneys argued before the U.S. Sixth Circuit Court of Appeals in Cincinnati Tuesday morning on whether former Sheriff Billy Long should get a further reduction in his sentence.
He was initially sentenced by Federal Judge Sandy Mattice to serve 168 months in federal prison after his conviction on a variety of charges related to his involvement with Eugene Overstreet.
That was later cut to 135 months based on a higher court ruling that a certain portion of the sentence was incorrectly computed.
Attorney Jerry Summers is maintaining that Long should have been given credit for his assistance to the government on other cases.
He said Long was punished because he aggressively attacked the informant Overstreet.
Prosecutor Perry Piper said that assistance did not rise to the level of granting the "5K" reduction. He said that decision had previously been upheld.
Each side had 15 minutes to argue before the panel of judges.
