Trustee Says Use Of Driveway Across Jack Brown Land By Jason And Kim Brown Hurting Property Value

Bankruptcy Trustee Jerry Farinash said continued use of a driveway across the Jack Brown property north of Soddy Daisy by son Jason Brown and his wife Kim is hurting the value of the land.

Attorney Farinash is handling the bankruptcy case in which Jack Brown is allegedly to have carried out a $12 million Ponzi Scheme.

The trustee has gained control of the Jack Brown property.

He noted that the home of Jason and Kim Brown is reached only by driving over the Jack Brown land. He said they have no easement for the driveway they are using.

Attorney Farinash is asking permission to file suit in Chancery Court to work out a driveway for the Jason Browns that is "the least burdensome" to the Jason Browns, but also puts it at the edge of the property.

Attorneys for the Jason Browns are fighting the request, saying the couple could wind up being landlocked with no way to get to their home. 

The Jason Brown house was built in 2007.
