Woman With No Driver's License, No Insurance Charged In Traffic Death On Highway 153

A woman without a driver's license or insurance has been charged with vehicular homicide and other counts in a traffic death in Hixson.

Authorities said there was an odor of alcohol on the person of 35-year-old Maria Leyva-Martinez at the time of the wreck on Aug. 3. She said she was coming from a party when the three-vehicle crash took place at 5400 Highway 153.

Ricky Duncan, 54, was badly injured in the wreck and he died Sept. 1. A 10-year employee at Koch Foods, he left behind a wife, son and two daughters.

In the accident near Hamilton Memorial Gardens, police said Mr. Duncan was driving his Chevrolet Prism southbound near a Ford Explorer when a Chevrolet Impala driven by Ms. Leyva-Martinez northbound came across and struck the Prism head-on.

Mr. Duncan was initially trapped in his vehicle.

Ms. Leyva-Martinez initially said she was not the driver.
