The District Attorney's Office has filed a petition seeking to try as an adult a 17-year-old charged with aggravated rape.
The teen is charged in connection with an attack on a 69-year-old runner in North Chattanooga on Monday morning.
The teen was identified by Juvenile Court officials as Diontae Smartt.
Authorities said he has given a confession.
Smartt appeared Thursday afternoon before Juvenile Court Magistrate Troy McDougal, who ordered that Smartt stay in custody at the Juvenile Detention Center pending the transfer hearing.
Juvenile Court Judge Rob Philyaw has not yet set a date for the transfer hearing.
The incident happened at approximately 7:30 a.m. on Mississippi Avenue.
Police initially said the suspect was described as a black male, 5’8’-5’9’’ inches in height and 180-200 pounds with a short afro/flat top style hair, wearing white or khaki shorts and a dark button-up shirt.
Police said the man who was attacked was out jogging.
