Red Bank Police Chief Tim Christol said Friday that a report of an incident in which a man said he was struck twice in the head by Officer Mark Kaylor after an Aug. 4 traffic stop has now been found.
The TBI, at the request of District Attorney Neal Pinkston after viewing a video, is investigating an incident in which Officer Kaylor allegedly struck another man seven times during an arrest in April.
Chief Christol said, "On October 1 and 2, 2014, many media outlets requested to view and/or obtain a copy of a Red Bank Police Department, Response to Resistance Report associated with an arrest conducted by officers of this agency on August 4, 2014.
At the time of the requests, an examination of the retention file for such reports was conducted and no such report was located. Various alternate locations were searched to determine if the report had in fact been inadvertently misfiled. At that point, I indicated to those who had submitted requests that the report did not exist.
"On October 3, 2014, Officer Kaylor reported that he had indeed filed the requisite report with his supervisor on the morning of August 4, 2014 and produced a copy of that report. SSGT. Noorbergen reported that she had reviewed his report, approved it and forwarded it for retention on August 5. She also produced a copy of the approved report which she maintained in her file. A copy of that report is presently on file and available for inspection at the police department.
"Neither Officer Kaylor nor SSGT. Noorbergen failed to meet their mandate to complete and submit this documentation in a timely manner. All of the appropriate reports associated with this arrest were completed and submitted electronically and/or in printed versions as appropriate by production type. No employee is suspected of any intentional act to undermine the integrity of the reporting process.
"While the original Response to Resistance report has not been located, both officers had taken the time in this matter to make copies for themselves. I am presently working to create a process that will better document the production of all reports not presently maintained electronically through our Records Management System. This process should work to reduce the possibility of future failures in the records keeping process."
