Former Chattanooga Police Sergeant Pleads No Contest Under Diversion Statute

A former sergeant at the Chattanooga Police Department in charge of the evidence room pleaded no contest under the diversion statute on Wednesday in connection with missing evidence.

Kevin Duane Kincer, 49, was indicted for three counts of official misconduct and three counts of theft of property.

The charges will be dismissed if he gets in no further trouble for two years.

He must perform 40 hours of public service.

The Tennessee Bureau of Investigation along with assistance from the Chattanooga Police Department, obtained the indictment after an investigation yielded evidence of missing property from evidence bags in the property room.

On Dec. 18, 2013, at the request of the District Attorney General Bill Cox, TBI launched an investigation into missing evidence from the property room. Several days earlier, the Major Crimes Division of the Chattanooga Police Department began an investigation into the possibility of missing evidence. Property technicians discovered evidence bags that appeared to have missing contents. Sgt. Kincer was responsible for oversight of daily operations of the property room. 

 After a comprehensive inventory of the property room and a thorough investigation by the Chattanooga Police Department and TBI, there was evidence that indicated Kincer’s involvement in the missing evidence, the TBI said. 

After his arrest, he was placed on leave without pay.
