Why Shouldn't WWTA Take Cash Payments?

I have been reading some of the articles of the man attempting to pay his water bill in cash to avoid paying a 1-3 percent surcharge for third parties receiving payments. I thought that our currency was good for all debts, public and private.  

Ignoring bad behavior from either side, why would this issue even make it to the courts?
