Mediated Resolution Reached In TVA Kingston Lawsuits

Friday, August 1, 2014

A mediated global resolution has been achieved in 63 lawsuits pending in U.S. District Court involving more than 850 plaintiffs asserting claims against the Tennessee Valley Authority arising from the 2008 ash spill at Kingston Fossil Plant.

The resolution, outlined in documents submitted Friday to the U.S. District Court in Knoxville, comes after nearly two years of mediation ordered by U.S. District Judge Thomas Varlan. The judge must still approve it.

Under the mediated global resolution, which was approved by the TVA Board of Directors, the 63 lawsuits will be dismissed and TVA will pay $27.8 million to the court clerk to be disbursed to the plaintiffs’ attorneys as ordered by the court.

Officials said, "Bringing this matter to a close is a significant milestone for all involved. TVA remains committed to completing the Kingston recovery project and restoring the community to as good as or better than it was before the spill. The restoration project is scheduled to be completed in 2015."
