One Man Dead After Shooting In Rock Spring Monday Night

Johnny "JJ" Montgomery, 31, of Ringgold, is dead and another person wounded after a shooting in Rock Spring Monday evening. 

Walker County detectives are investigating the incident at 1249 Straight Gut Road, where property owner Michael James Gobert, 52, is charged with one count murder and two counts of aggravated assault and is now in custody.  

Police said the property Gobert owns has two homes - the one he lives in and a mobile home where his stepdaughter, Nicole Carroll, lives. 

Police said Ms. Carroll invited three men over Monday evening and an argument broke out among the four that woke Gobert and his wife.  One of the men threw a humidifier at Ms. Carroll's head and the fight spilled out into the yard. 

Walker County Sheriff Steve Wilson said Gobert and his wife went outside, each with a .40-caliber Glock in their hands, and each fired a shot into the ground.  Sheriff Wilson said the three men ran to their car and at that point Gobert fired at the car approximately 14 times.  

Mr. Montgomery was driving the car and he was killed when he was shot in the head.  One of the passengers, Edrius Jamel Putman, 30, was shot in the leg.  The other man, Deisman Harrison, 28, ran from the scene and was not injured. 

Putman was charged with simple battery for throwing the humidifier at Ms. Carroll. 

Sheriff Wilson said, "Under Georgia law, we contend Gobert had no right to use deadly force in this case."  Mrs. Gobert will not face charges. Sheriff Wilson said both Gobert and his wife legally owned the guns.
