Mark Toney
Mark Toney, 26, was arrested on Saturday after he allegedly fought with police officers and attempted to flee into the woods on East Brainerd Road.
Police responded to a call about a disorder at the Kangaroo at the 7000 block of East Brainerd and found the complainant who said the defendant was actively harassing customers inside and would not leave.
Officers asked the defendant to step outside, but he appeared heavily intoxicated and refused, saying that he knew his rights.
Finally he complied, but could not produce an ID, saying it was inside. Officers escorted him back inside, but workers said his ID was not there and he began refusing to leave when asked again.
Officers again escorted Toney outside and asked him to calm down, but he refused, yelling, “I know my rights, this illegal.”
After attempting to pat down Toney for weapons, the officers tried to take him into custody, but the he swung his elbow at one officer, shoved the other, and attempted to flee.
The officers took him down and he began to fight aggressively, reaching for an officer’s weapon twice and kicking and hitting them repeatedly.
Toney eventually grabbed one officer’s legs, causing him to fall, which allowed Toney to get up and begin running again. Both officers fired their tasers unsuccessfully and continued pursuing him on foot.
They lost sight of Toney, but additional officers responded after the fight was reported and he was located in the woods in the 1300 block of Phils Drive.
Bond has been set at $15,000 for aggravated assault.
