Carjacking Victim Says Robber Aimed Gun At His Forehead, Pulled Trigger Several Times, But It Did Not Go Off

A carjacking victim testified Tuesday that one of the robbers aimed a revolver at his forehead, pulled the trigger several times, but it did not go off.

An Hispanic man, giving proof through an interpreter, said he was sitting in his car in front of his house on E. 33rd Street when the passenger door suddenly opened. In the incident on Sept. 13, he said a man pointed a gun at him and said, "Give me your phone. Give me your money."

He said he told the man, "Don't shoot me. I'm not doing anything."

But he said the man pulled the trigger on the revolver several times. It did not go off. After the last try, the gunman said, "Sh--."

The man said he handed over his phone and got out of the car. He said a second man came up to him and lifted his wallet from his pocket. It contained $540.

The pair then drove off in his white Toyota Corolla. He said another victim followed them as they left.

Police the next day arrested three 19-year-olds - Derrian Hill, of 2125 E. 28th St.; Addison Herman Foster, of 3406 Clio Ave., and Akello Miller, of 1629 Waterhouse St., East Ridge.

General Sessions Court Judge Gary Starnes bound aggravated robbery charges to the Grand Jury against Foster, who was identified as the gunman, and Hill. The charge was dismissed against Miller and he was set to be released.

Bond was raised from $100,000 to $250,000 for Foster and set at $250,000 for Hill. A bond for theft of property in another case against Hill was raised from $1,500 to $35,000.

The witness identified Herman from a picture lineup. He said the other robber was taller and had a shirt with a white stripe.

He said, "I'm still scared. They might have people do something to me."

Detective Kendon Massengale said the man's vehicle was found the next morning in East Ridge with the three defendants inside. The victim's cell phone was in the car. He said Hill was wearing a shirt with a stripe.

He said Foster and Hill said they had found the car in the back yard of Miller's relative and had gotten inside. They changed their story after being told they had been seen in the vehicle at the Brainerd Walmart in the middle of the night. It was on video.

Also found in the car was a five-shot Charter Arms revolver. It had four bullets in the chamber.
