Lawsuit Filed Against Red Bank, 2 Officers On "Brutal Beating" Of Arrestee

A federal lawsuit has been filed against Red Bank and two of its officers over "the brutal beating of an arrestee."

The 15-page complaint was filed by Candido Medina-Resendiz.

It names officer Greg Kaylor and supervisor Leigh Taylor Noorbergen. Kaylor has resigned from the force and been indicted by the Hamilton County Grand Jury on charges of assault, reckless endangerment and official misconduct.

The suit says officer Kaylor used his closed fist to punch Medina-Resendiz in the face in the early morning of April 14, 2014. It says the arrestee was lying defenseless on his stomach with the officer on top of him.

The suit says another officer was holding Medina-Resendiz's hands behind his back and a third officer was holding down his legs with a baton pressed on them. A fourth Red Bank officer was standing nearby armed with a Taser.

Medina-Resendiz suffered a blowout fracture to his eye socket and cuts and asphalt burns that ripped several layers of skin off the right side of his face, it was stated.

The suit says Kaylor told Medina-Resendiz, "I'm going to f------ kick your a--." He afterward yelled "stupid f---."

The suit says when supervisor Noorbergen arrived on the scene that Medina-Resendiz pleaded, "Por favor. Por favor" and she replied, "Por favor, my a--." She then repeatedly struck and tased the arrestee, who remained handcuffed, it was stated.

It says Kaylor had been fired from the Rhea County Sheriff's Office for failing to perform a duty and then lying about it.

Ms. Noorbergen had resigned from the Chattanooga Police Department after being suspended for 28 days without pay and ordered to undergo anger management counseling. An internal affairs probe found her guilty of improper arrest, filing false reports and untruthfulness.

The suit says Red Bank should not have hired either officer.

It says Red Bank failed to gather the video and witness statements from the Medina-Resendiz incident and found there was no excessive force.

The suit says Kaylor was making multiple DUI arrests, but some of those had blood alcohol levels below the drunk level.

The suit asks unspecified compensatory and punitive damages.
