TBI Child Death Investigation Yields Charges For Smithville Couple

Special agents from the Tennessee Bureau of Investigation have obtained indictments for a Smithville mother and her boyfriend in connection to the death of the woman’s 23-month-old child.

At the request of 13th District Attorney General Bryant Dunaway, and with the assistance of the Smithville Police Department, TBI special agents began investigating the death of Colten Alexander May on Sunday. Earlier that day, Cody Key, the boyfriend of the child’s mother, reported to law enforcement he found the child unresponsive while babysitting him in the early morning hours in a home on Christine Street. During the course of the investigation, agents developed information which led to Key as the individual responsible for the child’s death.

On Tuesday, a specially-called DeKalb County Grand Jury returned indictments for Key and the child’s mother, Jessica May, charging Key, 23, of Smithville, with one count of felony murder and one count of aggravated child abuse.

The indictments also charged Ms. May, 19, of Smithville with one count of aggravated child neglect.

TBI agents arrested both at their Smithville home and booked them into the DeKalb County Jail.

At the time of this release, Key was being held on $1,000,000 bond and Ms. May was being held on $300,000 bond.
