Warren & Griffin, P.C. has filed a lawsuit against Y.P. Advertising & Publishing, LLC and Y.P. Holdings, LLC. The plaintiff is demanding $250,000 in damages and claims that the defendant violated an advertising contract.
The two groups entered into a contract on May 16, 2014 whereby the defendants were obligated to publish a two-page color advertisement in the Rome, Ga. telephone book, as well as listings for the members of the Warren & Griffin P.C. law offices in that same telephone book.
The plaintiff claims that over the course of six months they paid the advertising group $26,556 for the expected service, but it became clear the following year that the defendant had not only failed to place the advertisement, but had also neglected to include any of the six required personal listings.
Meanwhile, the law office had leased an office in Rome, hired a paralegal to staff that office, and placed an attorney there, all while expecting that advertisement to come out later that year.
As a result of Y.P. Advertising & Publishing’s neglect of their contractual duty, Warren & Griffin is now claiming consequential damages including the cost of the lease, support staff, attorney, a loss of business from lacking advertisement, and payment for a non-existent ad.
The lawsuit call for a jury to hear the case deciding on the $250,000 claim and any other equitable relief the court deems just.
