A Chattanooga law firm has filed a class action lawsuit against Volkswagen Group of America, Inc. and Volkswagen, AG, in the wake of VW's emissions scandal.
The action by the firm of Patrick, Beard, Schulman & Jacoway, P.C. was one of three lawsuits filed in Chattanooga Federal Court seeking class action status on the Volkswagen calamity.
A suit in behalf of Helen Bullard was brought in Chattanooga by Nashville attorneys J. Gerard Stranch IV and Joe Leniski Jr. Ms. Bullard bought a 2014 Volkswagen Beetle with a 2.0 liter diesel engine in North Little Rock, Ar,.
Attorney W. Heath Brooks of Huntsville brought a suit in Chattanooga against VW in behalf of Huntsville citizen and VW purchaser Jeffrey Thomas Henderson.
The Patrick, Beard, Schulman & Jacoway lawsuit is based upon "the misrepresentation and fraud relating to certain diesel vehicles manufactured by Volkswagen."
It asks for unspecified compensatory and punitive damages.
The lawsuit says Volkswagen installed a “defeat device” in certain diesel models.
As a result of the intentional actions of Volkswagen, the individuals who purchased the TDI clean diesel engine models will incur substantial damages, probably in the thousands of dollars per vehicle, the lawsuit says.
Attorneys at the local firm said, "Volkswagen has been an important part of the Chattanooga community, but we are certainly disappointed by the actions that have been taken by Volkswagen in misrepresenting the true nature of its diesel engines. We hope that Volkswagen will now do the right thing and compensate these class members for the damages that they will incur."
The suit is filed in behalf of William and Earline Sonnenburg of Signal Mountain, Sakhi Abraham of Miami, Fla., Gordon Clifton Goodgame Jr. of Oak Ridge, Millard Ramsey and wife April Harvey of Fort Oglethorpe and Katie G. Warwick of Chattanooga.
