Rock City Suit Over Ochs Highway Sign Is Settled

A lawsuit brought by Rock City Gardens against Garnet Chapin over a sign on Ochs Highway at its intersection with the Ochs Highway extension has been settled.

Garnet Chapin said, "The matter has been resolved to the mutual satisfaction of the parties involved."

The suit said Rock City has long had a sign at that point with an arrow pointing in the direction of the Lookout Mountain attraction.

It said it was placed there around 1970 on land that in 1989 "purportedly was transferred" to Garnet Chapin.

The complaint said a tree fell on the sign and it was replaced early this year by Rock City at a cost of $8,900.

It said Rock City President Bill Chapin (a brother of Garnet Chapin)  on Jan. 8 received a letter from attorney Brian Smith asking why the replacement sign had been placed on the property.

In a second letter last Thursday, attorney Smith said if the sign was not removed by Monday that Garnet Chapin would "see to the removal" of the sign.

The suit, filed by attorneys Cody Roebuck and John Anderson, said, "It is necessary for See Rock City to maintain the replacement sign on the property, as it indicates which road should be traveled by persons who intend to visit Rock City at the intersection of Ochs Highway and Ochs Extension."

Rock City sought a temporary restraining order blocking Garnet Chapin from removing the sign. It was approved until there could be a court hearing. It had been set for Monday afternoon, but was canceled.
