The Planning Commission on Monday recommended denial on a request from the owner of Indian Sitar Cuisine at the 200 block of Market Street for commercial zoning back to Cherry Street under the new Form Based Code.
The owner said he would favor a four-story height on commercial from Market to Cherry.
Mark Degler, representing owners of townhomes along the 200 block of Cherry Street, was opposed to the commercial request.
Also opposed was builder Don Moon, a Cherry Street resident and former Planning Commission member.
The Planning Commission went along with the staff recommendation of a split zone - six-story commercial along Market Street and four-story residential along Cherry Street.
The commission also denied a request for commercial zoning at the 700 block of North Market Street. It opted for residential zoning up to three stories.
Nearby residents said that section of Hill City is mainly one-story, single-family homes. They said they did not want a three-story structure looking down on them at nearby streets like Spears Avenue.
