We Can Trust Marty Haynes As Assessor - And Response

As a former state of Tennessee Division of Property Assessment employee and current employee of the Hamilton County Assessor of Property, Mr. Bill Bennett, I am supporting Marty Haynes, the Republican nominee, for the office of assessor of property of Hamilton County.  Over my 27 years of experience with the Division of Property Assessment and my day to day experience with 33 assessors of property in the Middle Tennessee area, I know that Marty has the skills and understanding of the office necessary to lead the office. He will be a great leader and manager of the office.

I am deeply concerned with the misinformation that his Democrat opponent is putting out to the public.  Marty's opponent has obviously not researched any of the published laws in the Tennessee Code Annotated. If he had he would know that his claim about our current assessor of property, Mr.  Bennett, increasing revenue through the raising of assessments without checks and balances is absolutely false.  I am assuming that Marty's opponent is referring to the equalization of assessments during a reappraisal year. If so, if he had done his homework by referring to the Tennessee Code Annotated 67-5-1701, the tax rate law, he would know that:

 

Tennessee’s Certified Tax Rate law is intended to provide a revenue neutral condition for all jurisdictions after a mass reappraisal. It requires the tax rate be adjusted to produce the same amount of revenue as the previous year.  (See the following)

67-5-1701. General provisions. 

  (a)  (1) Upon a general reappraisal of property as determined by the state board of equalization, the county assessor of property shall certify to the governing bodies of the county and of each municipality within the county the total assessed value of taxable property within the jurisdiction of each governing body.

   (2) The assessor shall also furnish each governing body an estimate of the total assessed value of all new construction and improvements not included on the previous assessment roll and the assessed value of deletions from the previous assessment roll.

   (3) Exclusive of such new construction, improvements and deletions, each governing body, in the event of a general reappraisal as determined by the state board, shall determine and certify a tax rate which will provide the same ad valorem revenue for that jurisdiction as was levied during the previous year.
