Chattanooga Police said, according to a witness, Lamarcus Quintez Smith shot 24-year-old Dmarcus Collins though he had raised his hands in the air and was not armed.

Detective Daryl Slaughter said Smith claimed that Collins pulled a gun on him, but he said no weapon was found at a car on South Kelly Street where the July 30 shooting happened or in a nearby house where the victim dragged himself.

General Sessions Court Judge Gary Starnes bound charges of criminal homicide, especially aggravated robbery, and possession of a weapon during commission of a dangerous felony to the Grand Jury against the 22-year-old Smith.

Detective Slaughter said Smith told him at one point that he planned to rob Collins and said a cousin of Collins had shot at him in the past "so he was going to make him feel it."

He also said Smith put out his hands to be cuffed and stated, "I did it.

I'm done. Take me to jail."

It was testified that the victim was shot in the side with the bullet coming out the other side.

There was a trail of blood where he dragged himself to the house. Those inside heard a shot and then a thump at the door. They tried to give him CPR.

He was unresponsive when medics arrived, and he died at the hospital.

Smith was later arrested in Cobb County, Ga. Police said a Taurus 9mm handgun was recovered during the Georgia arrest.

Smith admitted that was his gun and that it was the one used in the Collins slaying, it was stated.
