A Hixson man had his Jeep hit by a train on Friday night, then he wound up in jail.
Robert Gudell, 34, was charged with DUI, violating the Implied Consent Law, and a railroad crossing violation.
In the incident at 9:05 p.m. at a crossing at Old Mill Road, officers found a Jeep that had been struck by a train.
Gudell told police he was giving two friends a ride and they were on the crossing when the train headed toward them. He decided to hop out of the vehicle.
The conductor said he saw Gudell leave the vehicle, but no one else.
Police said there was a strong odor of an intoxicant coming from Gudell and he was very unsteady on his feet. He had bloody, watery red eyes.
Gudell agreed to a breathalyzer test, but kept putting his tongue in the way so there could not be a reading.
He was taken on to jail and given a blood test there.
