Air Pollution Board Eyeing Ordinance Changes

City Council members have been notified that the Chattanooga-Hamilton County Air Pollution Control Board will hold a public hearing on Monday, March 5, to receive comments on proposed revisions in local ordinances and regulations -- including raising asbestos, permit and emission fees.

City officials are now studying the proposed changes, weighing what if any actions they need to take in response to the proposed changes.

According to the notification sent to city council members by APCB officials, matters to be considered at the public hearing also include:

* Housekeeping revisions
* Revision of new source review rules (including Prevention of Significant Deterioration of Air Quality PSD Rules)
* Elimination of outdates rules
* Provisions for Plantwide Applicability Limitations (PALS)
* Revised ambient air quality standards
* Revisions to grain elevator-related rule
* Revision to the insignificant activities list
* Incorporation (by reference) of federal regulations, as authorized by Tennessee Code Annotated

According to the notice sent by APCB to the city, the public hearing is scheduled for 5 p.m. in Room 1-A in the Development Resource Center at 1250 Market Street on March 5.

"A deliberative session of the board to consideration recommendation of the adoption of these proposed revisions may also be held on March 5, 2007, or may be extended or postponed by reason of the quantity of public comment," the notice explains.

Materials pertaining to the proposed changes can be inspected at the APCB offices at 6125 Preservation Drive between 8 a.m. and 4:30 p.m. Monday through Friday. They can also be viewed at http://www.pollutionsolution.org/regulations/proposed_regulatory_revisions.aspx.

"Any person desiring to present comments should be prepared to offer a written statement to be incorporated into the hearing record," according to the notice. "Written statements not presented at the hearing may only be considered part of the record if delivered to the office of the bureau director by 4:30 p.m. on Friday, March 2 . . . Facsimile transmission is not acceptable."
