Man Who Shot Girlfriend In Rectum Pleads Guilty To Gun Charge Montgomery Hilton Garner Remains In Federal Custody posted April 23, 2007 A man who allegedly shot his girlfriend in the rectum and got off on a legal technicality pleaded guilty Monday morning to a federal gun charge. Montgomery Hilton Garner faces up to 10 years in federal prison. Prosecutor Chris Poole said the government will seek to show at the sentencing hearing that Garner was trying to kill Roxanne Arrowsmith in the Oct. 26, 2003, incident. Judge Sandy Mattice will set the sentence on July 30. Garner remains in federal custody. He had only one night of freedom after being released on the state attempted-murder charge. Magistate Bill Carter earlier found that Garner is a flight risk as well as a danger to the community. Garner spent three and a half years in jail awaiting trial on the original charge. Ms. Arrowsmith survived, but has undergone numerous surgeries. An appeals court threw out the case on a technicality. ATF Task Force Officer David Ashley earlier testified that Garner and the girlfriend first said the shooting was accidental. He said Ms. Arrowsmith later said Garner was upset and he grabbed her by the legs, pulled them apart, put the gun's barrel in her rectum and pulled the trigger. Garner later said he crawled in bed with Ms. Arrowsmith, cuddled up to her and the gun went off in her rectum. |
