Marti Rutherford Takes New Residence In District 6
Says Former Landlord Scott Was Being Harassed

City Councilwoman Marti Rutherford, who is under fire on whether she is a valid resident of the district she was elected to represent, has moved to a new District 6 location.

Her attorney, John Anderson, confirmed that Ms. Rutherford has vacated the "mother-in-law apartment" she had at a residence owned by Rusty Scott at 3442 Alta Vista Dr.

Attorney Anderson said Ms. Rutherford has moved to Sweetbriar Avenue. He said he does not know the exact address, but "it is within District 6."

The attorney said it is "a fully furnished house. She is not sharing it with anyone."

He said he does not know who she is renting from.

Attorney Anderson said Ms. Rutherford moved because "she was concerned that Mr. Scott was getting a lot of unwanted attention. People were calling him and pulling into his driveway."

Attorney Anderson also said that City Attorney Randy Nelson has presented a long list of documents related to the residency issue. He said he sees no problem in complying with the city attorney's subpoena.

Ms. Rutherford's longtime home is on Hemphill Avenue. It was originally in District 6, but it was moved to District 5 during a time she was out of office.

A group of Brainerd residents claim Ms. Rutherford has continued to live on Hemphill Avenue - outside her district. They filed a formal complaint with the city attorney's office.

City Attorney Nelson said he is investigating the matter and should have a report to the City Council in three weeks.
