Lawsuit Filed After Fall At "Cluttered" Patten Towers

A resident of Patten Towers has filed a lawsuit saying he slipped on a puddle of urine in a hallway.

Bruce Wilbourn is asking $300,000 in damages and his wife, Dorothy Wilbourn, $100,000.

The Circuit Court complaint filed by Steven Dobson was brought against Patten Towers L.P.II and Walden Security.

The suit says the Wilbourns live on the seventh floor, which is designated for handicapped or disabled residents.

It says the hallways of Patten Towers are regularly littered "with all manners of debris, including, but not limited to, urine, defecation, rotting food, empty beer cans, and other garbage."

It says the defendants "would only very occasionally remove this debris and clean the common areas and facilities."

Mr. Wilbourn said he was returning to his room last June 22 when he slipped in the urine. He said it caused him to fall backward against his wheelchair, eventually landing on the floor.

The suit says he suffered severe injury to his shoulder, neck and collar bone.

Patten Towers is a low-income senior facility at the old Patten Hotel at Market and 11th streets.
