Appeals Court Upholds 5-Month Suspension For Chattanooga Lawyer posted July 2, 2009 The Tennessee Supreme Court has upheld a five-month suspension of the law practice of Chattanooga attorney Owen Maddox. Attorney Maddox had filed suit in Chancery Court asking that he receive a lesser punishment such as a public censure. Judge Jon Kerry Blackwood uphold the five-month suspension imposed by the state Board of Professional Responsibility. The state high court said, "After careful review of the record, we find no error in the ruling of the hearing panel and, accordingly, we affirm the judgment of the trial court." The ruling says attorney Maddux was retained on June 11, 1999, by Robert and Louise Livingston to represent them in a personal injury case arising out of a collision that occurred in Florida on Feb. 17, 1999. It says attorney Maddux never filed suit for the Livingstons, and the statute of limitations expired. A petition for discipline was filed on May 23, 2006, and the judgment was entered after a hearing on Dec. 14, 2006. |
