Joe Prebul Declines Government Offer; To Go To Trial Nov. 16

Former Chattanooga auto dealer Joe Prebul has declined an offer in the case in which he faces wire fraud charges in New York City.

Prosecutors told Judge William H. Pauley III that Prebul is now set to go to trial on Nov. 16.

Prebul is facing federal charges on allegations he misused millions of dollars obtained from his brother-in-law, New York City music mogul Danny Bensusan.

Prebul's former dealerships have been sold through Bankruptcy Court and he is also in personal bankruptcy.

His attorneys are asking Judge Pauley to rule that the government cannot use tapes secretly made of him talking with the Bensusans.

The letter informing Judge Pauley of Prebul's decision was sent Oct. 28 and received by the judge on Oct. 29. It was made public on Thursday.
