The ordinance states that a Townhouse is a "single-family dwelling unit attached by fireproof common walls to other similar type units; each unit having an open space for light, air and access in the front and rear. There shall be not less than four (4), nor more than twelve (12) such units connected together." The existing units as currently developed would not meet this basic definition because there would be 2 units attached together. The building code for a "townhouse" is very specific related to the construction of this type of unit. The Chief Building Official for East Ridge is checking into the technicalities of constructing this unit. The applicant would have to meet the standards for this or retro-fit the units accordingly. In addition, the units would have to be legally subdivided and unless they are constructed in conformance with the building code we are not sure this can be done without the proper spacing between attached units. This should not be approved until the technical questions have been resolved. The City of East Ridge could amend the definition in the ordinance but the technical building requirements might prove to be too daunting to retrofit these units into code complying townhouses. The developer will meet with neighborhood representatives prior to Planning Commission. The developer has been requested to grant easements along the rear of the property for the Mountain Creek Greenway, and to consider a faηade with improved architectural detail. By doing so the Landscape Coordinator would be able to give them some concession on their landscaping.
