Prosecutor Asks Stiff Sentence For "Corrupt Police Officer On The Take"
Defense Attorney Says Gerry Davis Should Get Lenient Term

A federal prosecutor is asking a stiff sentence for former Chattanooga Police Sgt. Gerry Davis, calling him "a corrupt police officer on the take."

Prosecutor Gary Humble said Davis took thousands of dollars in payoffs from nightclub owner Joe Cooke and also used his position to gain sexual favors from women.

However, the new attorney for Davis is asking for a "lenient" sentence. David S. Wigler of Knoxville filed 29 pages of letters of support for Davis, including many from family members. He also cited his work record.

Sentencing is Dec. 2 at 2 p.m. before Judge Curtis Collier.

Davis is also facing a rape charge in state court.

He was fired from the city police department after his federal conviction.

Davis was earlier convicted in a federal bribery case. His sentencing range is 10-16 months. Prosecutor Humble is asking that he get a stiffer sentence. He said, "Given the heinous behavior over a long period of time of this defendant, this sentence is clearly inadequate. The United States therefore respectfully asks the Court to impose a greater sentence."

Prosecutor Humble said, "Additional evidence developed during the course of the investigation revealed that the defendant seriously misued his badge not only to secure additional money, but also to coerce women into committing sexual favors for him.

"The United States has proof that on one occasion, for example, in January 2005, the defendant used his badge to coerce oral sex from a female outside the Club Voodoo.

"In addition to that episode, the United States has developed evidence of numerous instances of similar conduct by the defendant. That is, the defendant misused his badge to coerce sex from women."
