800-Pound Woman Won't Be Able To Come To Court To Testify

Prosecutors say an 800-pound woman will not be able to come to court to testify in a case in which her husband and daughter are charged with incest and failing to properly care for her.

Prosecutor Dave Denny said the state expects to get a doctor's report saying 53-year-old Peggy Johnson is not able to make it to court.

He said Ms. Johnson is so large that she cannot get out of the door at her residence at 1111 E. 33rd St.

The prosecutor said the state expects to call other witnesses about the allegations.

The warrant in the case says Charles M. Johnson, 34, and Mary Alice Nichols, 23, admitted to having sex with one another. Ms. Nichols, who lives at 607 W. Wheeler St., is the step-daughter of Johnson.

Police said they conducted a wellness check following reports that Johnson and Ms. Nichols were neglecting Peggy Johnson and her mentally challenged son, Robert Young.

Officers said there was a strong odor of urine and feces in the room. They said Ms. Johnson was lying in her own urine and her sheet was covered with urine and feces.

Police said Ms. Johnson "was forced to watch" as her husband and daughter had sex.

Officers said the pair had left Ms. Johnson alone for more than nine hours at a time in violation of a protective services order.

Prosecutor Denny said a state caseworker has been assigned to help Peggy Johnson while her husband and daughter remain in jail.

Their hearing is set for next Wednesday in General Sessions Court.
