Chancellor Howell Peoples ruled Monday that Republican Senate nominee Bob Corker will have to give a 3-hour deposition, though his attorney said he is too busy with the election.
The judge declined to grant the request by attorney Roger Dickson that the deposition be put off until after the Nov. 7 election.
Attorney Dickson said the former Chattanooga mayor has an extremely hectic schedule between now and the vote.
Chancellor Peoples said Mr. Corker had not come to the motion hearing or submitted an affidavit in regard to the delay request.
Corker was Chattanooga mayor at the time property was sold by his firm for the Wal-Mart.
The lawsuit contends the city and Corker's construction company failed to protect the land donated to the city under a conservation easement.
Corker officials have claimed the suit was revived for political purposes.
The deposition is set for Oct. 20.
