A Circuit Court lawsuit has been filed against Kelly Vannoy over the sale of a house in East Ridge.
Mr. Vannoy has been in the news after Washington Hills residents complained about houses he trucked into that neighborhood off Highway 58.
The suit, filed by Michael Anthony James and his wife, Peggy E. James, also names Allied Home Mortgage Capital Corporation as a defendant.
The suit says the James couple last August agreed to buy a house at 5005 16th Ave.
It says Mr. Vannoy told them the house had been appraised at $100,000, but they later learned the appraisal made that June was at $74,000. The couple bought it at that price.
The suit, filed by attorney Charles Wright, said Mr. Vannoy made a number of promises that he did not keep. These were listed as putting in a dishwasher, leveling the back yard and planting grass, putting up a screen door, putting a fence in the back yard, replacing the dryer vent and providing a one-year warranty.
It says Mr. Vannoy "created a paper trail" that made it appear the couple had made a down payment in order to get the loan. It says the loan would not have been made had the loan company known there was not a down payment.
The suit says the buyers were told they would have a fixed-rate mortgage, but they learned it was at a variable rate.
The complaint asks treble damages as well as court costs and attorney fees.
Attorney Wright said Mr. and Mrs. James were first-time homebuyers. He said Mrs. James is barely literate and Mr. James is illiterate.
