Allstate Insurance Company says in a lawsuit that it will not provide coverage in connection with a fall at the Parkway Towers that left a St. Elmo youth a quadriplegic.
Allstate said in the Chancery Court suit that Parkway Towers owners Gary and Nancy Fillers had two policies.
But it maintains they did not cover the incident in which Asher Mendonsa went up on the vacant building and fell through a hole three stories.
The Mendonsas have filed a lawsuit in Circuit Court asking over $12 million in damages.
That case is set to go to trial Nov. 8 before Judge Marie Williams. It is expected to last until Nov. 17.
Allstate said it has "no duty to defend" the Fillers couple on the Mendonsa lawsuit.
The Allstate complaint was filed by attorneys Barry Howard and Nathaniel Cherry of Nashville.
