Attorneys Ask Lifting Of Home Confinement For Hazelwood After Higher Court Allows Him To Stay Out During Appeal; Government Is Opposed

Attorneys for former Pilot Travel Centers president Mark Hazelwood are asking Judge Curtis Collier for the lifting of his home confinement after the Sixth Circuit Court of Appeals said he could remain out during his appeal.

In the alternative, the attorneys ask that he be able to leave his Knoxville home between 10 a.m. and 4 p.m.

The motion also requests that Hazelwood be allowed to sell his airplane and boat after rendering both operable.

Prosecutors said they do not object to Hazelwood selling his airplane and boat. However, they do oppose the lifting of the home confinement.

The attorneys said Hazelwood, who was sentenced to serve 12 and one-half years in federal prison for defrauding trucking firms, has not shown any inclination that he would flee. 

Hazelwood had been slated to report to prison at the end of this month.

The Appeals Court noted he raised the issue on his appeal of whether racist tapes should have been introduced at his trial.

The appeals court said, "The recordings were offered by the government to prove that he participated in conduct that, if disclosed, would have jeopardized Pilot's success and reputation."
