Dean Says Federal Ruling Left His Office $350,000 Short Of Funds

Criminal Court Clerk Vince Dean said a federal ruling left his office $350,000 short of funds.

He is asking the County Commission to make a special appropriation in that amount. The vote will be next Wednesday.

Mr. Dean said his office in the past could take driver's licenses in cases of non-payment. 

Judge Aleta Trauger of Nashville directed the commissioner of the Department of Safety and Homeland Security to no longer revoke driver's licenses for nonpayment of court debt.

She said, "The court declares that Tenn.

Code Ann. § 40-24-105(b), as written, violates the Due Process and Equal Protection Clauses of the Fourteenth Amendment to the United States Constitution because it provides for no exception from revocation for debtors whose failure to pay is based solely on their indigence."
