Ricky Porter Sentenced To 5 Years In Federal Prison In Case In Which Cocaine Was Sold Out Of 3rd Street Family Dollar

Ricky Porter was sentenced on Monday to serve five years in federal prison for cocaine sales in Chattanooga.

Porter, 35, appeared before Judge Sandy Mattice.

His guideline sentencing range was 46-57 months due to his low criminal record, but he had a mandatory 60-months to serve.

From April to August 2017, the ATF used a confidential informant to make controlled drug buys from Porter and his associates. 

On April 4, 2017, the ATF made a controlled buy of an Arminius .32 caliber revolver from Porter. There was discussion of buying cocaine, but Porter said he did not have any at the time.

On April 13, 2017, the ATF, through an informant, made a purchase of an H&R .38 caliber revolver from Porter at his home. Porter and the informant then drove together to the Citgo gas station on East Brainerd Road. There Porter got out of the informant's vehicle and Porter got into a maroon Dodge pickup driven by another drug dealer, Jeffrey Bone. Porter came back to the informant's vehicle after a short time and sold him over 10 grams of cocaine.

On July 13, 2017, the informant bought cocaine from Bone and Porter. Porter rode with the informant to the Family Dollar on Third Street where Bone was working. Porter went inside the Family Dollar, then returned 25 grams of cocaine. The informant had asked for 28 grams and later that day Porter got another three grams for him in a deal at the Sav A Ton on East Brainerd Road.

Bone is set to be sentenced next Monday.

Porter has been out on bond since his federal arrest, and attorney Erin Rust said he has "really been doing well."

She said his boss at Burger King gave him a raving review, saying he was upbeat and friendly, an amazing team player and had leadership abilities.

Porter is to self report to prison on Aug. 7.

He will be on supervised release for four years after serving the time.
