Summary Judgment Granted For Defendants In 2011 Club Fathom Shooting

The Tennessee Court of Appeals has ordered the granting of summary judgment for the defendants in the lawsuit brought in connection with a shooting outside Club Fathom on Christmas Eve 2011.

Jerterrius Marshawn Akridge and others filed the suit against Club Fathom, a youth outreach ministry.

Circuit Court Judge Jackie Bolton had denied summary judgment. She did agree to grant an interlocutory appeal on the issue.

The Appeals Court said, "We determine that the court erred in failing to grant summary judgment to the defendants regarding the plaintiffs’ negligence claims. We therefore reverse the judgment of the trial court.

"We remand the case for entry of summary judgment regarding the plaintiffs’ negligence claims and for a determination regarding the remaining lease issue."
