Testimony Murky In Shooting At Highway 58 Apartments

It was unclear at the close of a long preliminary hearing on Monday why 26-year-old Shane Hurt was shot outside an apartment complex on Highway 58 on May 23.

The victim gave barely-audible, halting testimony that at one point caused prosecutor Cameron Williams to declare of his own witness, "That doesn't make any sense."

One woman who was on the scene of the shooting said she just got out of a mental facility and anything she said was unreliable.

The victim's girlfriend, Mindy Barkett, said, "Nothing makes sense why anybody got hurt. I don't know why he got shot."

Police said the person charged, Kia Key, is not talking.

Judge Gary Starnes wound up dismissing two of the charges against the 24-year-old Ms. Key - attempted first-degree murder and tampering with evidence. Her remaining charge is aggravated assault.

Hurt, who admitted buying a pistol just before the shooting though he is a convicted felon, said he got together with Ms. Key that day while his girlfriend was asleep. Ms. Key lives in Apt. 2, while he was in Apt. 5.

He said they went in a vehicle belonging to the brother of his girlfriend to see "J. Mike," who sold him $10 worth of marijuana. He said he paid $350 for the 40 caliber Taurus semi-automatic handgun he wound up getting shot with.

He said the shooting happened shortly after they arrived back at the apartment complex. He said, "I don't know why she shot me. There was no argument or nothing like that."

He did say that Ms. Key was wanting him to take her to pick up her son in Cleveland.

The victim's arm was heavily bandaged. He said the bullet went through his left arm and into his abdomen.

The girlfriend said she woke up and found that her boyfriend, money and ride were all gone. She said she called repeatedly and got no answer.

She said she was back in the apartment after they got back when she heard a shot. She said she went outside to find Hurt slumped to the ground screaming and Ms. Kia holding the handgun aimed toward where he had been standing.

Detective Matthew Puglise said he found a trail of blood between Apt. 5 and Apt. 2.

He said the gun had been slung through the window of a vacant apartment. It landed in a sink.

One 40 caliber slug was found in grass near the sidewalk where the shooting took place.
