Two people testified Tuesday that they have lingering injuries after being shot by Allen Wayne Graham at Old Dayton Pike on July 25.

Two counts of aggravated assault were bound to the Grand Jury against Graham, 33, of Pikeville.

According to testimony, Mandy Jordan and Michael Gross were apparently hit by the same shot fired from a 12-gauge shotgun.

Angelica Henley, who has children by Graham but is not married to him, said they had an argument and he took her car. She said she later learned that he had it at Old Dayton Pike in Hamilton County.

She said she went there in a pickup truck with friends. She said she spotted her car at a top of a hill, and she said Graham and his nephews were threatening to set it on fire and roll it down the hill.

Ms. Henley said the pickup truck's engine died at the driveway at the bottom of the hill. She said some of the nephews came down and got into a tussle with the friend who had driven her there.

One of the friends, Mandy Jordan, said the driver of the pickup was in a struggle with the nephews when Graham came down with the shotgun. She said he fired a shot that struck Michael Gross, the brother of the pickup driver, and also hit her.

She said it left pellets in her leg from the knee down, and she still has no feeling in the section around her big toe.

Michael Gross said he got a call about an altercation involving his brother. He said he got his six-year-old daughter out of the vehicle and his mother jumped in. He said he joined in the altercation.

He said there were no blows struck and it was like one of the nephews "was dancing with me."

At one point he said the nephews shouted, "Alley Cat, come on. Alley Cat, come on."

He said Graham then appeared with the shotgun.

The witness said, "He never said a word. He just aimed it and pulled the trigger."

Michael Gross was on crutches and said doctors told him it may be a year or more before he gets any feeling in his foot. He said he still has 80 pellets in his leg.

Graham told Det. Jeff Baker that he fired to protect his nephews.

He remains in jail under $200,000 bond.
