Written Ruling By Juvenile Judge Philyaw Affirms Charges Against Nayadley, Williams, Montgomery

A written opinion issued by Juvenile Court Judge Rob Philyaw on Thursday affirms his earlier refusal to dismiss charges brought against the Ooltewah High athletic director and basketball coach and assistant coach for failure to report child abuse.

A preliminary hearing is set for Jesse Nayadley, Andre Montgomery and Karl Williams on Feb. 15 before Judge Philyaw.

In the ruling, he points out a special section of state law dealing with child abuse that deals specifically with school officials and school board members.

He said the state laws on failure to report child abuse "lack the clarity and guidance that is necessary for both the protection of children and the due process of those accused of failing to report."
