Attorney Sam Elliott will be representing the City Industrial Development Board (IDB) in the new lawsuit filed by citizen Helen Burns Sharp.
He replaces former City Attorney Mike McMahan, who is a focus of the second Burns lawsuit involving the $9 million Black Creek TIF (Tax Increment Financing).
The suit hits actions of attorney McMahan in securing the TIF and a reconfirmation of the TIF.
City Attorney Wade Hinton told members of the IDB that attorney Elliott was in the case earlier and is very familiar with the facts.
He said attorney Elliott "had some dealings with previous defendants" and he asked the IDB to waive that potential conflict of interest. The board did so after Attorney Hinton said that should have no effect on his representation.
It was the last IDB meeting for James Woods.
