Authorities said a 10-year-old boy witnessed his father being shot in the face at a gas station on Dayton Pike.
Donald Thomas Stuard II, 29, of Old Washington Highway, Dayton, is charged with attempted first-degree murder.
The boy said he and his father, Adam Brown, were waiting at the gas pump at the Kangaroo to meet his grandmother to pick him up for an exchange.
He said a car pulled up behind them at the pump and the man in the other car said something. He said his father got out of their car and walked toward the other vehicle.
He said the man in the car then fired the shot. Mr. Brown was taken to Erlanger Hospital.
Detectives were given the tag number of the other vehicle, which left the scene.
They were able to find Stuard who admitted firing the shot, saying the man was coming toward him and scared him.
He said he threw the gun he used in the water at the Old Washington Bridge in Rhea County.
