Dalton Man Arrested In Officer-Involved Shooting

  • Wednesday, November 19, 2014

The Dalton Police Department arrested Baldemar Jaramillo-Garcia, 20, of 205 Cappes Street Wednesday after a domestic incident during which he pointed a gun at a Dalton police officer. The officer involved fired one shot at Jaramillo-Garcia which did not hit him. Nobody was injured in the incident.

The incident happened shortly after 8:30 a.m. at the townhouse apartment at 205 Cappes Street. A Dalton police officer was passing by the area when he was flagged down by a woman on the street and alerted to a fight in progress at the residence.

When the officer arrived, he found Jaramillo-Garcia and a woman in a physical fight in front of the residence. As other DPD officers arrived, Jaramillo-Garcia was given verbal commands to surrender.  Jaramillo-Garcia, who was wearing a ballistic bulletproof vest, initially told officers to shoot him and refused to surrender. Jaramillo-Garcia then ran back inside the residence.

While Jaramillo-Garcia retreated upstairs, officers were able to get the woman and her two children, a three-year-old and a three-month-old infant, out of the apartment and safely away from the building.  Jaramillo-Garcia then appeared in an upstairs window and pointed a long gun at one of the Dalton officers. The officer fired once, hitting near the window but not hitting anyone. Jaramillo-Garcia then threw his gun out of the window. The gun was a rifle-style BB gun. A short time later, Jaramillo-Garcia came out of the front door and surrendered without further incident.

In accordance with Dalton Police Department policy, the Georgia Bureau of Investigation was called in to assist with the investigation into the shooting incident. The officer involved was placed on paid administrative leave pending the review of the incident, which is also Dalton Police Department policy.  That investigation is continuing.

Jaramillo-Garcia was charged with aggravated assault against a law enforcement officer, reckless conduct, cruelty to children in the second degree, and making terroristic threats.
