Detective Says Murder Victim Was Trying To Switch Gangs When He Was Shot By Fellow Gang Member

Detective Lucas Fuller testified Thursday that a gang member who was shot and killed at close range by a fellow Rollin 40 Crip gang member was trying to switch to the Gangster Disciples.

Defense attorney Garth Best said it appeared that Malik "Avenue" Blackstock was shot accidentally by Julian "C-Shooter" Pasley.

However, General Sessions Court Judge Gary Starnes said, "In the court's opinion, when you point a gun at someone else and you shoot and they die, it's not an accident."

A charge of criminal homicide was bound to the Grand Jury against Pasley.

Judge Starnes raised his bond from $500,000 to $1 million. Prosecutor Lance Pope said Pasley was out on bond on an aggravated robbery charge at the time of the April 7 incident at the Windsor Terrace Apartments in East Chattanooga.

Pasley, 19, had recently gotten out of prison from a two-year sentence on a case involving a man who was shot multiple times in the legs.

At the Thursday hearing, Riana Davenport testified that she saw Pasley fire and Blackstock slump to the floor. Detective Fuller said Ms. Davenport at one said she did not see the shooting, but she later acknowledged that she did.

She said she had been at the apartment of Shantasia "Woonie" Mills along with Pasley and Blackstock. She said they had been smoking marijuana and "chilling" together.

Ms. Davenport said when Pasley pulled out a 44 revolver and began spinning it around and playing with it, she said, "H--- no, we don't play with guns."

But she said Pasley pointed the gun at Blackstock, who told him, "Get that gun out of my face." She said Pasley then called Blackstock a "b---- a--" and fired a shot.

The witness said the 18-year-old Blackstock kept saying, "It hurts. I don't want to die."

She said she told him to keep talking and "keep your eyes open." But she said he died in front of her.

She said Pasley ran out after telling her to say that Blockstock shot himself. Witnesses said Pasley had blood on his forehead from the gun recoiling.

Shantasia Mills said after he was hit, Blackstock told Pasley, "D---, cousin, I'm shot."

She said she was in the bathroom when the gun went off.

She said Pasley "looked shocked."

Detective Fuller said the victim was hit in the right shoulder and the bullet then went into his chest. He said a 44 bullet was removed during the autopsy.
